Plain-English Explanation
The five prescribed categories are the number of complaints received during the year; the number disposed of during the year; the number pending for more than ninety days; the number of workshops or awareness programmes carried out; and the nature of action taken by the employer or District Officer.
Section 21(1) requires the Internal Committee or Local Committee, as applicable, to prepare an annual report in each calendar year and submit it to the employer and the District Officer. Rule 14 identifies the prescribed reporting information; Section 21 supplies that Committee-reporting obligation.
Section 21(2) separately requires the District Officer to forward a brief report on the annual reports received to the State Government. This is a further statutory reporting responsibility, not a direction in Rule 14 to send every complaint file to the public or to PIH.
Section 22 is the employer’s separate obligation to include the number of cases filed, if any, and their disposal in the organisation’s annual report, or to intimate the number of cases, if any, to the District Officer where no such organisational annual report is required. That obligation should not be collapsed into the Committee’s five-field report as one generic ‘annual return’.
Rule 14 does not itself state one nationwide filing deadline, universal portal or additional set of fields. Any applicable State or Union Territory directions must be checked for their current authority and scope. Its information categories do not call for public disclosure of names or identifying complaint narratives.
Practical Significance
The Committee’s report, the District Officer’s onward brief report and the employer’s organisational reporting have different actors and legal bases. Preparing one does not, by itself, show that the other responsibilities have been met.
Scope, Conditions and Safeguards
- The original threshold is cases pending for more than ninety days; it should not be changed to all pending cases or to ninety working days.
- The five fields include the nature of action taken, not just numerical totals. They do not prescribe disclosure of complaint identities.
- The Section 21 Committee report and Section 22 employer obligation remain distinct, including their stated recipients and reporting context.
