Plain-English Explanation
The written request of the aggrieved woman is an express condition. On that request, the Committee may recommend the measures described in Rule 8 to the employer while the inquiry is pending.
For work performance and confidential reporting, the Committee may recommend that the respondent be restrained from carrying out those functions for the aggrieved woman, with the responsibility assigned to another officer.
In an educational institution, the Committee may recommend restraining the respondent from supervising any academic activity of the aggrieved woman. This is a separate, education-specific form of relief.
Section 12(1)(c) provides for other prescribed relief. Its separate transfer and leave provisions are not the same measures as Rule 8. Section 12(3) also addresses the employer’s implementation of recommendations and reporting that implementation to the Committee.
Practical Significance
A pending inquiry may involve a reporting or supervisory relationship. Rule 8 identifies particular measures that can be recommended in that setting without treating an interim recommendation as a finding on the allegation.
Scope, Conditions and Safeguards
- A written request is required; the Rule does not describe the measures as automatic.
- Interim relief and a final finding of misconduct serve different purposes.
- Transfer or leave under Section 12 and the specific reporting or academic-supervision measures under Rule 8 should be identified separately.
