Plain-English Explanation

Section 4(4) provides for prescribed fees or allowances for the member appointed from a non-governmental organisation or association. Rule 3’s own wording addresses the member appointed from amongst non-government organisations and specifies ₹200 per day for holding Internal Committee proceedings.

The original Rule also describes reimbursement of travel by three-tier air-conditioned train or air-conditioned bus and auto rickshaw or taxi, or the actual amount spent on travel, whichever is less. The stated travel conditions and lower-amount limit are part of the provision; this is not an unrestricted travel entitlement.

The employer is responsible for payment of the allowance referred to in sub-rule (1). This is distinct from Rule 5, which addresses Local Committee allowances and assigns payment responsibility to the District Officer.

The prescribed allowance is not a market consultancy fee, training honorarium or universal fee for every person who might qualify under Section 4(2)(c). A separate professional engagement should not be described as the fee fixed by Rule 3 merely because the provider is an external IC member.

Practical Significance

The appointment category, purpose of the payment and travel conditions matter. Recording those separately helps distinguish a statutory allowance from a separately agreed professional service.

Scope, Conditions and Safeguards

  • The ₹200 figure is the amount in the original Rule for holding the stated proceedings; no later adjustment is asserted here.
  • The Rule’s described appointment category must not be expanded automatically to every external-member category under Section 4(2)(c).
  • Local Committee payment arrangements are governed separately by Rule 5.
