Plain-English Explanation

The Central Government made these Rules under Section 29 of the POSH Act. Their full name identifies the legal instrument; the short expression ‘POSH Rules, 2013’ is a convenient reference to it.

Rule 1(2) makes publication in the Official Gazette the commencement event. G.S.R. 769(E), dated 9 December 2013, is the Rules notification. The Act’s separate commencement provision is Section 1(3); India Code records its commencement notification as S.O. 3606(E), also dated 9 December 2013.

The dates coincide, but the notifications do different legal work: one brings the Act into force and the other notifies the Rules. Neither is an approval of an individual employer’s committee, policy or compliance arrangements.

Practical Significance

When identifying the legal source for a procedure, distinguish the Act from the Rules and record the notification relevant to the provision being read.

Scope, Conditions and Safeguards

  • The Rules notification and the Act’s commencement notification are separate instruments, even though both are dated 9 December 2013.
  • Commencement of legislation does not certify an organisation’s compliance.
