Plain-English Explanation

The Chairperson is entitled to the original Rule’s ₹250 per day for holding Local Committee proceedings. Rule 5(2) separately provides ₹200 per day for members other than those nominated under Section 7(1)(b) and (d).

Those excluded categories are the woman working in the specified local area nominated under Section 7(1)(b), and the concerned district social-welfare or women-and-child-development officer serving ex officio under Section 7(1)(d). The ₹200 provision should not be presented as an identical entitlement for every LC member.

Rule 5(2) also describes travel reimbursement for its specified member category: the stated three-tier air-conditioned train or air-conditioned bus and auto rickshaw or taxi travel, or actual travel expenditure, whichever is less. The original text does not give the Chairperson that travel entitlement in Rule 5(1); the sub-rules should not be merged.

The District Officer is responsible for payment of the allowances referred to in sub-rules (1) and (2). Section 7(4) supplies the related Act framework. Rule 3’s employer-paid IC arrangements are separate.

Practical Significance

The Chairperson’s allowance, the eligible member allowance, the excluded categories and the payer have different roles in this provision. Treating them as one common rate would obscure those distinctions.

Scope, Conditions and Safeguards

  • ₹250 and ₹200 are the amounts in the original Rule; no later adjustment is asserted here.
  • An exclusion from this particular allowance provision does not, by itself, decide whether another applicable public-service rule provides a different entitlement.
  • The employer’s payment responsibility under Rule 3 must not be substituted for the District Officer’s responsibility under Rule 5.

Related POSH Act Provisions
