POSH Policy Drafting Toolkit

A clause-based Word drafting framework for reviewing policy scope, responsibilities, prevention, complaint routes, process safeguards and governance approval.

The direct answer

A POSH policy should accurately reflect the Act, applicable Rules, the employer's structure and the organisation's approved procedures. This clause-based drafting toolkit helps policy owners identify decisions, source references and review gaps; it is a drafting aid, not a ready-to-adopt legal policy.

Use with review. This editable resource is a structured starting point. It is not a government form, certification or guarantee of compliance. Confirm current law, applicability and internal approvals before adoption.

Purpose and application

What this toolkit covers

01

Purpose and intended users

The toolkit gives employers, HR policy owners and legal reviewers a structured Word document for drafting or revising a workplace POSH policy. It organises drafting decisions and review evidence while leaving organisation-specific rules, routes and approvals for the employer to complete.

02

Policy anatomy

Sixteen numbered sections separate proposed policy text from reviewer instructions. They cover scope and definitions, prohibited conduct, Committee contacts, complaint assistance and time limits, voluntary conciliation, inquiry safeguards, interim relief, findings and appeals, confidentiality, organisational retaliation commitments, malicious-complaint safeguards, employer duties and document governance. Five annexures organise contacts, communication, version history, drafting decisions and actual review evidence.

03

Separate legal duties from organisational choices

The drafting notes identify legal-source questions separately from recommended operating controls. The policy owner should map provisions to the Act and Rules, then confirm which internal processes are authorised organisational choices. Do not present a recommended workflow, form, deadline or service level as statutory unless an applicable legal source supports it.

04

Customisation and legal review

Confirm employer identity, covered workplaces, applicable service rules, the correct Committee contacts, communication channels, internal approvals and cross-references. Reconcile all complaint and inquiry language with current law and the organisation's lawful process before adoption. Obtain qualified legal review where the drafting requires interpretation or changes process rights.

05

Confidentiality and data handling

Use fictional or blank examples only while drafting. Do not insert live complaint narratives or identifiable inquiry records into a working copy shared beyond authorised reviewers. Section 16 imposes specific confidentiality restrictions; align access, storage and retention with applicable law and organisational controls.

06

Limitations and further guidance

A completed policy document does not establish lawful implementation or compliance. Use the Policy Drafting Guide and verify every legal reference against the official Act and Rules before approval and dissemination.

Keep the distinctions clear

Law, Rules and recommended controls

01

Act requirement

Check the applicable provision in the POSH Act and the organisation's facts.

02

Rules requirement

Check prescribed details in the POSH Rules and current applicable instructions.

03

Recommended control

Use internal trackers and review steps as governance support, not as universal statutory duties.

Review before adoption

Common implementation mistakes

  • Adopting a generic policy without confirming employer identity, workplace scope, applicable service rules and current Committee contacts.
  • Converting a recommended organisational workflow into a claimed universal statutory requirement.
  • Routing complaints through an internal HR screening step that may alter the lawful process or access to the Committee.

Questions about this toolkit

Frequently asked questions

Can the toolkit be adopted as written?

No. It contains structured drafting prompts and requires organisation-specific completion, legal review and authorised approval.

Does every recommended control belong in the policy?

No. Select controls appropriate to the organisation and label recommendations accurately; do not describe them as universal legal duties without supporting authority.

Confidentiality and data minimisation

Keep sensitive records appropriately controlled

These are blank organisational tools. Do not submit complaint narratives, identifiable inquiry records or witness information to PIH to complete them. Restrict internal access according to the information recorded. Section 16 of the POSH Act imposes specific confidentiality restrictions; the public Templates Library is not a complaint-management system or statutory filing portal.
