Internal Committee Constitution Order Template

An editable employer order structure for recording the workplace coverage, nominated member categories, appointment terms and authorisation of an Internal Committee.

The direct answer

Section 4 of the POSH Act requires an employer to constitute an Internal Committee by an order in writing. The order should identify the workplace or administrative unit covered and record members in their nominated capacities. The organisation must confirm actual composition, tenure and location arrangements against the applicable law before issue.

Use with review. This editable resource is a structured starting point. It is not a government form, certification or guarantee of compliance. Confirm current law, applicability and internal approvals before adoption.

Purpose and application

What this toolkit covers

01

Purpose and users

This editable order framework helps an employer record an Internal Committee constitution decision for a specified workplace or administrative unit. It is intended for the issuing employer, HR, legal and compliance teams; it does not itself constitute a Committee or validate nominations.

02

What the written order should capture

The document provides employer and workplace particulars, order reference, effective date, member appointment table, statutory capacity labels, appointment period, administrative communication responsibility and employer authorisation fields.

  • Presiding Officer category and the applicable statutory alternative, if relevant
  • At least two employee-member positions and an external-category member position
  • Member name, category, designation, relevant workplace, appointment date and specified term end
  • Order issuer, authority, signature and organisation-specific review notes
03

Act requirements and decisions to verify

Section 4 governs constitution and composition, including the woman Presiding Officer requirement, employee members, the external-category member and at least half of nominated members being women. The precise statutory alternatives and office or administrative-unit coverage must be checked for the employer's structure. The template deliberately does not declare that one order automatically covers every office nationally.

04

Customisation and approval

Confirm the issuing employer, covered unit, member eligibility, gender representation, appointment terms and applicable service rules. Section 4(3) permits a specified period not exceeding three years from nomination; enter the actual period rather than assuming an automatic three-year term. Proposed order text and drafting notes are labelled separately. Add employee-member rows where needed, record the actual review in the annexures, and obtain appropriate organisational and legal approval before issue.

05

Confidentiality and limits

The order includes a qualified reminder to observe applicable Section 16 confidentiality obligations for complaint and inquiry information. It does not promise that every internal communication is confidential, confer management authority over findings, or replace procedural training and the IC Formation Guide.

06

Recommended governance controls

Maintaining an order register, recording superseded orders, assigning a communication owner and scheduling a periodic composition review are useful organisational controls. They should not be mistaken for separate universal statutory duties unless an applicable source establishes them.

Keep the distinctions clear

Law, Rules and recommended controls

01

Act requirement

Check the applicable provision in the POSH Act and the organisation's facts.

02

Rules requirement

Check prescribed details in the POSH Rules and current applicable instructions.

03

Recommended control

Use internal trackers and review steps as governance support, not as universal statutory duties.

Review before adoption

Common implementation mistakes

  • Using one order's generic national-coverage sentence without confirming the applicable workplace or administrative-unit arrangement.
  • Pre-filling a three-year term or treating the member table as proof of eligibility without checking the applicable statutory requirements.
  • Giving management authority to direct Committee findings or promising unrestricted confidentiality for every internal communication.

Questions about this toolkit

Frequently asked questions

Does this template establish a valid Internal Committee?

No. The employer must make and issue an appropriate written order and verify the actual statutory composition, eligibility, coverage and appointment terms.

Should the order list every office?

Specify the workplace or administrative unit covered and assess the applicable arrangements for the organisation's actual locations. Do not assume one generic national statement is sufficient.

Confidentiality and data minimisation

Keep sensitive records appropriately controlled

These are blank organisational tools. Do not submit complaint narratives, identifiable inquiry records or witness information to PIH to complete them. Restrict internal access according to the information recorded. Section 16 of the POSH Act imposes specific confidentiality restrictions; the public Templates Library is not a complaint-management system or statutory filing portal.
